  5. Louisiana Revised Statutes 14:73.1
  6.  
  7. Definitions.
  8.  
  9. As used in this Subpart unless the context clearly indicates
  10. otherwise:
  11.  
  12. (1) "Access" means to program, to execute programs on, to
  13. communicate with, store data in, retrieve data from, or otherwise
  14. make use of any resources, including data or programs, of a
  15. computer, computer system or computer network.
  16.  
  17. (2) "Computer" includes an electronic, magnetic, optical or other
  18. high-speed data processing device or system performing logical,
  19. arithmetic and storage functions and includes any property, data
  20. storage facility or communications facility directly related to
  21. or operating in conjunction with such device or system.
  22. "Computer" shall not include an automated typewriter or
  23. type-setter, a machine designed solely for word processing, or a
  24. portable hand-held calculator, nor shall "computer" include any
  25. other device which contains components similar to those in
  26. computers but which have the sole function of controlling the
  27. device for the single purpose for which the device is intended.
  28.  
  29. (3) "Computer network" means a set of related, remotely connected
  30. devices and communications facilities including at least one
  31. computer system with the capability to transmit data through 
  32. communication facilities.
  33.  
  34. (4) "Computer program" means an ordered set of data representing 
  35. coded instructions or statements that when executed by a computer 
  36. cause the computer to process data.
  37.  
  38. (5) "Computer services" means providing access to or service or 
  39. data from a computer, a computer system or a computer network.
  40.  
  41. (6) "Computer software" means a set of computer programs, 
  42. procedures and associated documentation concerned with operation 
  43. of a computer system.
  44.  
  45. (7) "Computer system" means a set of functionally related, 
  46. connected or unconnected, computer equipment, devices or computer 
  47. software.
  48.  
  49. (8) "Financial instrument" means any check, draft, money order, 
  50. certificate of deposit, letter of credit, bill of exchange, 
  51. access card as defined in R.S. 14:67.3, or marketable security.
  52.  
  53. (9) "Intellectual property" includes data, computer programs, 
  54. computer software, trade secrets as defined in R.S. 51:1431(4), 
  55. copyrighted material and confidential or proprietary information, 
  56. in any form or medium, when such is sorted in, produced by, or 
  57. intended for use or storage with or in a computer, a computer 
  58. system or a computer network.
  59.  
  60. (10) "Proper means" includes:
  61.  
  62. (a) Discovery by independent invention;
  63.  
  64. (b) discovery by "reverse engineering"; that is, by starting with 
  65. the known product and working backward to find the method by 
  66. which it was developed. The acquisition of the known product 
  67. shall be by lawful means;
  68.  
  69. (c) Discovery under license or authority of the owner;
  70.  
  71. (d) Observation of the property in public use or on public 
  72. display; or,
  73.  
  74. (e) Discovery in public literature.
  75.  
  76. (11) "Property" means property as defined in R.S. 14:2(8) and 
  77. shall specifically include but not be limited to, financial 
  78. instruments, electronically stored or produced data and computer 
  79. programs, whether in machine readable or human readable form.
  80.  
  81. SECTION 73.2. Offenses against intellectual property
  82.  
  83. A. An offense against intellectual property is the intentional:
  84.  
  85. (1) Destruction, insertion,n or modification, without consent, of 
  86. intellectual property; or
  87.  
  88. (2) Disclosure, use, copying, taking or accessing, without 
  89. consent, of intellectual property.
  90.  
  91. B. (1) Whoever commits an offense against intellectual property 
  92. shall be fined not more than five hundred dollars, or imprisoned 
  93. for not more than six months, or both, for the commission of the 
  94. offense.
  95.  
  96. (2) However, when the damage or loss amounts to a value of five 
  97. hundred dollars or more, the offender may be fined not more than 
  98. ten thousand dollars, or imprisonment with or without hard labor, 
  99. for not more than five years, or both.
  100.  
  101. C. The provisions of this section shall not apply to the 
  102. disclosure, use, copying, taking, or accessing by proper means as 
  103. defined in this Subpart.
  104.  
  105. Section 73.3. Offenses against computer equipment or supplies
  106.  
  107. A. An offense against computer equipment or supplies is the 
  108. intentional modification or destruction, without consent, of 
  109. computer equipment or supplies used or intended to be used in a 
  110. computer, computer system, or computer network.
  111.  
  112. B. (1) Whoever commits an offense against computer equipment 
  113. shall be fined not more than five hundred dollars, or imprisoned 
  114. for not more than six months, or both, for the commission of the 
  115. offense.
  116.  
  117. (2) However, when the damage or loss amounts to a value of five 
  118. hundred dollars or more, the offender may be fined not more than 
  119. ten thousand dollars, or imprisonment with or without hard labor, 
  120. for not more than five years, or both.
  121.  
  122. Section 73.4. Computer fraud.
  123.     
  124. A. Computer fraud is the accessing or causing to be accessed of 
  125. any computer, computer system, computer network, or any part 
  126. thereof with the intent to:
  127.  
  128. (1) Defraud, or
  129.  
  130. (2) Obtain money, property or services by means of false or 
  131. fraudulent conduct, practices or representations, or through the 
  132. alteration, deletion or insertion of programs or data.
  133.  
  134. (2) Whoever commits the offense of computer fraud shall be fined 
  135. more than ten thousand Dollars, or imprisoned with or without 
  136. hard labor for not more than five years, or both.
